Terms and Conditions

You will be submitting an order for the kinds and quantities of products you indicate in the order form when you click on the Pay by Credit/Debit Card button on the Checkout and payment details page. All orders will incorporate our terms of sale.

TERMS OF SALE

1. The promotion does not constitute an offer to sell the product described or any products at all. We will at all times adhere to any legal restrictions imposed on us in connection with the sale, and the offering for sale, of any product on this site.
2. By clicking on the Pay by Credit/Debit Card button on the payment details page, you will be submitting an order which will incorporate all these terms.
3. We reserve the right not to accept your order, in which case we will not have any further obligation to you.
4. We may accept the whole or part of your order, both in respect of the kinds of products ordered and the quantity of products ordered. The price will be reduced accordingly.
5. We will notify you by email when your order is submitted to us. We will debit your account with the appropriate amount in full on accepting your order. We will be deemed not to have accepted your order until we have debited your account. The sale of the products will occur at the place and the time that particular products are allocated to your order.
6. We may debit your account for more than the amount stated in the promotion to reflect any increase in the cost of the products for reasons beyond our reasonable control - for example, because of increases in duty or taxation, or adverse currency fluctuations. Any increase in the price will be fair and proportionate.
7. Our obligation is to deliver the products at the delivery address you have specified in your order to a person who appears to be authorised to take delivery. We will not despatch the products until we have received cleared funds. Delivery is not available on public holidays. We may deliver the products at any time during the day.
8. We may use an independent carrier. The carrier may attempt to contact you using the telephone number provided. If there is no one to accept the delivery of your order a message will be left by the carrier so you can arrange a delivery time, directly with the carrier. Ultimately, if the carrier is unable to deliver your order it will be returned to us and you will be charged for it to be re-despatched or in the event of a failed or cancelled order, charged the delivery cost only.
9. Where glass packaged items are delivered, we take no responsibilities for damages or breakages, or damages to other products included in the same delivery.
10. At our discretion we may credit your account for any damaged items, if these are notified to us at the time of delivery or within twenty four hours of delivery.
11. We will endeavour to supply all items with a shelf life in excess of one month. Excluding promotionally priced items, all items sold will have a minimum shelf life of at least two weeks from the date of delivery. Excluding promotionally priced items, where we fail to meet the two week shelf life, we will offer a full refund for that particular product.

THE FOLLOWING TERMS LIMIT, AND IN SOME CASES EXCLUDE ALTOGETHER, OUR LIABILITY TO YOU.

12. We will not have any responsibility or liability for the non-delivery of any products unless either a) all of the products charged for are not delivered, or b) you give us full details of the shortages within twenty four hours of the part delivery.
13. Our total liability to you for the non-delivery of any products is limited to delivering the products to you within 10 days of your telling us about the non-delivery or, at our option, crediting your account with the value of the products not delivered. We reserve the right to substitute a product of equal or similar value in the event of supply difficulties. Where possible we will endeavour to contact you prior to delivery to confirm acceptance of a substitute product.
14. For the purposes of trading on this site, promotional or priced marked products of the original product are treated as identical to the original product both in terms of suitability and value, and are not to be treated as substitute products.
15. Our total liability to you in respect of any substitute products which you have told us are not acceptable to you is limited to crediting your account with the value of the substitute product upon return of the same.
16. We will not have any responsibility or liability in connection with any defects in the quality of the products unless you give us full details of the defects within 7 days of when the defect ought to have been apparent to you.
17. Afrocaribbeanfoods.com accepts no liability arising from links to external website or errors (including typographical errors) contained in, or any omissions from, this website. These external links are being provided as a convenience and for informational purposes only; they do not constitute an endorsement or an approval by Afrocaribbeanfoods.com of any of the products, services or opinions of the corporation or organization or individual.

19. Afrocaribbeanfoods.com does not accept any responsibility for late or non-delivery of goods arising from incorrect delivery information being provided.
